Fundamento constitucional de la protección a las víctimas en el proceso penal español

Description

El proceso penal español se encuentra sometido en la actualidad a una interesante revisión en torno a las funciones que está llamado a desempeñar. Así, examinado desde la óptica de los derechos y garantías fundamen tales que establece la Constitución de 1978, el proceso penal asume no sólo la aplicación del ius puniendi, sino que concentra otras funciones que tienen como eje principal al agresor y la víctima. Ahora bien, si durante décadas ha sido examinado desde la perspectiva de las garantías constitucionales de defensa del imputado y de las exigencias derivadas del derecho a un proceso justo, asistimos en la actualidad a la reivindicación de un espacio efectivo para la víctima dentro del proceso penal. Este trabajo propone analizar esta nueva configuración desde la propia Constitución y concretamente a partir de su artículo 24 para evaluar los me canismos de respuesta de nuestro sistema judicial para hacer frente a los intereses legítimos de quienes han sido víctimas de un delito.

Abstract

The Spanish Criminal Proceedings are now in the thoers of an interesting update of their functions. In this way, from the point of view of the rights and guarantees suported by the Constitution of 1978, the criminal process assumes not only the enforcement of the ius puniendi, but also develops another funtions which have the victim and the aggressor as the assential part of it. During many decades the criminal process has been focused on the defense of the aggressor's constitutional guarantees and on the requirements of a fair trial. Present times claim for a more important role and defense of the victim into the criminal law. This study tries to analyze this new conception starting by checking the Constitution of 1978 and concretely its article 24, and evaluationg the mechanism of answer that de Spanish judgment system has to defend the legitimate rights of those who have been vistims of an offence
